The U.S. Consumer Product Safety Commission (CPSC) announced today that Toy Power Inc. of Los Angeles, Calif., will pay $115,000 to resolve allegations that it violated a 1989 U.S. district court order. CPSC alleged that Toy Power and its former president M. Chan imported 25 different models of toys bearing lead paint that it failed to test and 10 types of toys containing small parts.
Toy Power, an importer and distributor of toys and other children's products, and its new president, Michael Wu, agreed under the settlement to a modified court order. The new order, which includes the $115,000 payment, requires Toy Power to notify the CPSC in writing at least ten days before importing toys into the country. Toy Power is also permanently enjoined from distributing any toys containing excessive lead-in-paint or small parts. The case is United States of America v. Toy Power Inc. (C. D. Calif., Civil No. 89-2099-SVW).
CPSC Chairman Ann Brown stated: "This settlement demonstrates that CPSC will act forcefully and decisively to protect consumers. Companies that import or manufacture toys have special responsibilities, and the commission will be particularly vigilant in protecting the children who play with those toys."
About the U.S. CPSC
The U.S. Consumer Product Safety Commission (CPSC) is charged with protecting the public from unreasonable risk of injury associated with the use of thousands of types of consumer products. Deaths, injuries, and property damage from consumer product-related incidents cost the nation more than $1 trillion annually. Since the CPSC was established more than 50 years ago, it has worked to ensure the safety of consumer products, which has contributed to a decline in injuries associated with these products.
Federal law prohibits any person from selling products subject to a Commission ordered recall or a voluntary recall undertaken in consultation with the CPSC.
