Decision
The Commission voted (3-2) to approve publication in the Federal Register ( "FR ") of the direct final rule, as drafted. Chairman Kaye, Commissioner Adler and Commissioner Robinson voted to approve the direct final rule, as drafted. Commissioner Mohorovic and Commissioner Buerkle voted to approve the direct final rule with changes proposed by Commissioner Mohorovic. (The proposed amendments are attached.)
The Commission voted unanimously (5-0) to approve publication in the FR of notice of proposed rulemaking for a determination for unfinished and untreated wood for the ASTM heavy elements limits in ASTM F963-11, as drafted.
