Chairman Elliot F. Kaye convened the January 27,2016, 11:00 a.m., meeting ofthe U.S.Consumer Product Safety Commission in open session. Commissioner Robert S. Adler,Commissioner Marietta S. Robinson and Commissioner Ann Marie Buerkle were in attendance.Commissioner Joseph P. Mohorovic participated by telephone. Chairman Kaye made welcoming remarks and summarized the matter.
Decisional Matter: Final Rule to Amend 16 C.F .R. Part 1 031, Commission Participation andCommission Employee Involvement in Voluntary Standards Activities (Briefing package dated (December 30, 2015, OS No, 3884)
Robert Howell, Deputy Executive Director for Safety Operations, and Mary A. House,Attorney from the Office of General Counsel, were present to respond to any questions.Chairman Kaye called for any questions for the staff. Chairman Kaye and Commissioner Adler passed on asking any questions. Commissioner Robinson, Commissioner Buerkle and Commissioner Mohorovic asked questions about voluntary standards participation process.
Chairman Kaye called for any amendments to the draft final rule. Commissioner Buerklemoved to direct the Executive Director to submit to the Commission after 14 months a report with the staff's assessment of voluntary standards activities, including the voting and leadership activities and resources. Commissioner Adler seconded the motion. Chairman Kaye suggested that the report be For Official Use Only ("FOUO"). Commissioner Buerkle agreed to amend the motion to make the report FOUO. The Commissioners discussed the amendment. Chairman Kaye called for the vote on the motion. The Commission voted unanimously (5-0) to adopt the motion.
Chairman Kaye called for any other amendments or discussion. Hearing none, Chairman Kaye moved for approval of the staff's draft final rule amending 16 C.F .R. Part 1031, regarding Commission participation and Commission employee involvement in voluntary standards and publication of same in the Federal Register ("FR ''). Chairman Kaye called for the vote. The Commission voted unanimously (5-0) to approve the staffs draft final rule and publication in the FR of the final rule.
Chairman Kaye made a statement regarding the matter and called for any other closingstatements of the Commissioners. Commissioners Adler, Robinson and Mohorovic madeclosing statements.
There being no other business, Chairman Kaye adjourned the meeting at 11 :45 a.m.
