Statement of Chair Alexander D. Hoehn-Saric Regarding the U.S. Circuit Court Decision in FinnBin, LLC vs. CPSC

I am pleased the Court has rejected the challenge to CPSC’s rule protecting infants from unsafe sleep environments. CPSC’s rule is vital to protecting the most vulnerable among us, babies. Recently, Congress spoke on the importance of safe sleep with the enactment of the Safe Sleep for Babies Act. This law provides additional support for CPSC’s actions setting strong safety standards for infant sleep products.

Today’s ruling eliminates any doubt as to the enforceability of the infant sleep rule and, rest assured, CPSC will actively enforce it. As the CPSC continues its work, I would like to take the opportunity to remind caregivers that babies should only sleep on a firm, flat surface such as a crib without pillows or blankets. If a baby falls asleep in another environment such as a bouncer or car seat, the child should be moved to a safe sleep environment.
