After BACL Donguann’s acceptance of accreditation was initially withdrawn on December 13, 2023, CPSC conducted an investigation pursuant to 16 C.F.R. § 1112.51 and made findings of fact concluding that the adverse action was based on evidence that a manufacturer “had exerted undue influence . . . or otherwise . . . compromised the integrity of the [laboratory’s] testing process.” 16 C.F.R. § 1112.47(a). The findings included evidence that over a period of approximately 10 years BACL Donguann fraudulently used the address and emblem of a different lab on approximately 690 test reports. BACL Donguann may reapply for acceptance of accreditation pursuant to 16 C.F.R. § 1112.13 with additional requirements as stated in the Final Notice.
1606Shenzhen LCS Compliance Testing Laboratory Ltd.03/28/2024Adverse action: On March 28, 2024, pursuant to 16 C.F.R. § 1112.51(e), the Office of Compliance and Field Operations at the U.S. Consumer Product Safety Commission provided Final Notice that it has determined to permanently withdraw acceptance of the accreditation of Shenzhen LCS Compliance Testing Laboratory Ltd. (CPSC Laboratory Approval System ID 1606). After Shenzhen LCS’s acceptance of accreditation was initially withdrawn on December 13, 2023, CPSC conducted an investigation pursuant to 16 C.F.R. § 1112.51 and made findings of fact concluding that the adverse action was based on evidence that a manufacturer had “exerted undue influence . . . or otherwise interfered with or compromised the integrity of the [laboratory’s] testing process.” 16 C.F.R. § 1112.47(a). This evidence included a June 2021 penalty issued by a Chinese governmental entity against Shenzhen LCS for, among other things, issuing false test reports. Shenzhen LCS may reapply for acceptance accreditation pursuant to 16 C.F.R. § 1112.13 with additional requirements as stated in the Final Notice.
