CPSC Provisionally Accepts Consent Agreement With Tennessee Company

The U.S. Consumer Product Safety Commission has provisionally accepted a consent order prohibiting the First National Company, Memphis, Tennessee, a division, and two officers of that company from manufacturing, selling or importing products which fail to meet the requirements of the Flammable Fabrics Act it was announced today in the Federal Register.

The Commission's investigations found that although the corporation was labeling sizes 0-6X sleepwear flammable, as required by the Standard for the Flammability for Children's Sleepwear (DOC FF 3-71) for non-complying garments, 74 l/2 dozen boys, size 3 pajamas, distributed nationwide, had labels which were partially hidden. The corporation, at the suggestion of the Commission, informed its customers of the problem and asked if they would apply a stick-on label to the plastic bag encasing each violative garment. As a result of this effort, 172 retailers (81%) agreed to label their stock of size 3, style number 73-3805. According to a Commission spokesman it is presumed that those customers failing to respond had no garments left in stock.

This agreement is for settlement purposes only and does not constitute an admission by the company that it has violated the law. Any future violation of this consent agreement by the corporation could result in the assessment of substantial civil penalties.

The complaint and consent order will remain on the public record for 60 days through January 9, 1976, during which time any interested person may submit comments to the Office of the Secretary, Consumer Product Safety Commission, 1750 K Street, N.W., Washington, D.C. 20207.

After considering any comments, the Commission may finally accept the agreement or withdraw its provisional acceptance.
