Decision
The Commission voted unanimously (5-0) to approve publication in the Federal Register, with changes, of a notice of proposed rulemaking that would amend 16 C.F.R. part 1025, the Commission's Rules of Practice for Adjudicative Proceedings ("Rules") to align the Rules with the modem Federal Rules of Civil Procedure, and to reflect modem administrative and civillitigation practice.
The Commission voted (3-2) to approve Commissioner Adler's amendments to the adjudicatory rule and the notice· preamble. Chairman Kaye, Commissioner Adler and CommissionerMohorovic voted to approve the Commission Adler amendments. Commissioner Buerkle andCommissioner Robinson did not vote to approve the Adler amendments.The Commission vote unanimously (5-0) to approve Commissioner Mohorovic's amendments tothe rule 16 CFR 1025.13 and .24, and Commissioner Robinson's amendments to 16 CFR1025.68, and to the notice preamble.
