Decision

The Commission voted unanimously (3-0) to approve the proposed All-Terrain Vehicle (ATV) Action Plan of Rich Godfrey & Associates, Inc., d/b/a Coleman Powersports (Coleman) dated January 8, 2014. Under Section 42(a) of the Consumer Product Safety Act, 15 U.S.C. § 2089(a), manufacturers and importers may only import or distribute in commerce any new assembled or unassembled ATV that complies with the mandatory standard, and is subject to an action plan filed with, and approved, by the Commission, contains labeling certifying compliance with such action plan, and identifies the manufacturer, importer or private labeler and the ATV action plan to which it is subject. Coleman’s action plan adequately describes actions Coleman agrees to take to promote ATV safety, including rider training, dissemination of safety information, age recommendations, policies governing marketing and sale of the ATVs, monitoring of such sales, and other safety-related measures.
